Welcome to AIgames123 (the "Service", "we", "us", "our"). The Service is a free, community-driven archive where users can upload and play AI-generated games. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you are 13 or older. If you are under 18, you confirm that you have permission from a parent or legal guardian to use the Service.

If we learn that we have collected information from a child under 13, we will delete it as required by the Children's Online Privacy Protection Act (COPPA).

2. Accounts

You may browse and play games without an account. To upload games or interact with content (upvote, edit, delete your own games), you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized access

We may suspend or terminate accounts that violate these Terms.

3. User Content

"User Content" means any games, descriptions, thumbnails, display names, profile pictures, and other materials you upload to the Service.

3.1 Your responsibilities

You are solely responsible for your User Content. By uploading, you represent and warrant that:

• You own all rights to the content, or have full permission from the rights-holder to upload and share it
• The content does not infringe any third party's copyright, trademark, publicity, or other rights
• The content complies with these Terms and all applicable laws

3.2 License you grant us

By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content for the sole purpose of operating and improving the Service. This license ends when you delete your content, except where we are required to retain copies for legal or backup purposes.

You retain ownership of your content. We do not claim ownership of anything you upload.

3.3 Prohibited content

You may NOT upload, create, or share content that:

• Infringes copyrights, trademarks, or other intellectual property rights (including unauthorized use of game characters, sprites, music, or assets from existing commercial games)
• Contains sexually explicit material, pornography, or sexually suggestive content involving anyone who appears under 18
• Depicts or promotes graphic violence, gore, self-harm, or suicide
• Promotes hate speech, harassment, discrimination, or threats against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Contains malware, viruses, exploits, cryptocurrency miners, or any code intended to harm users or systems
• Phishes for credentials, impersonates other people or services, or facilitates fraud
• Violates any applicable U.S., state, or local law
• Spams, advertises commercial products, or repeatedly posts low-quality / duplicate content

We reserve the right (but have no obligation) to remove any content that violates these rules, with or without notice.

4. AI-Generated Content

The Service is intended for games that are partially or fully created using AI tools (such as large language models, image generators, or AI code assistants). You agree that:

• You will not upload content generated in violation of the terms of service of the AI tool used
• You will not pass off third-party AI-generated content as your own when prohibited by the underlying model's license
• You acknowledge that AI tools may inadvertently reproduce copyrighted material from training data; you remain responsible for the legality of what you publish

5. Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to other users' accounts or to our infrastructure
• Probe, scan, or test the vulnerability of the Service without our written permission
• Use the Service to send spam, malware, or unsolicited communications
• Scrape, copy, or systematically extract content from the Service except as permitted by `robots.txt`
• Use automated means (bots, scripts) to upload content, manipulate upvotes, or inflate metrics
• Reverse-engineer, decompile, or attempt to extract source code from the Service except as permitted by law
• Interfere with other users' ability to use the Service

6. Intellectual Property of the Service

The Service itself — including its name, design, code, logos, and overall presentation — is owned by the Service's operator and is protected by copyright and other intellectual property laws. You may not copy or reuse these elements without permission.

7. DMCA Copyright Policy

We respect intellectual property rights and respond to valid DMCA takedown notices. See our DMCA Notice & Takedown Procedure for details on how to submit a copyright complaint.

Repeat infringers will have their accounts terminated in accordance with the DMCA's repeat-infringer policy.

8. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using the Service, you consent to that data handling.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that:

• The Service will be uninterrupted, secure, or error-free
• User-uploaded games are safe, accurate, or free of malware (we make reasonable efforts but cannot guarantee)
• Any content uploaded by users is lawful, accurate, or non-infringing

You play user-uploaded games at your own risk. Although games run inside a sandboxed iframe, we cannot guarantee that all sandbox protections will be effective in every case.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total cumulative liability to you for all claims relating to the Service shall not exceed one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless the Service's operator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property right

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time. Sections that by their nature should survive termination (e.g., ownership, indemnification, limitations of liability) will survive.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the new Terms, stop using the Service.

14. Governing Law

These Terms are governed by the laws of the United States and, where applicable, the State of California, without regard to conflict-of-laws principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
